This section provides an outline of the terms of sale for products and services available from Eluktronics, in general. The terms consist of the terms on this page and:
- For product warranties, the Eluktronics Warranty Agreement.
- For shipping & return policies.
- For pricing policies & quantity limits.
- For the payment & order verification policy.
Export Policy:
Eluktronics now ships worldwide. If you have purchased an Eluktronics branded item and shipped said product outside of the USA, or are traveling overseas and encounter an issue, Eluktronics will happily provide technical assistance over the phone or e-mail. However, in the event of a required physical hardware repair, the PC will need to be located in the USA. It is the customers responsibility (when located outside of the USA) to pay for shipping to our facility.
LIMITATIONS:
CUSTOMER EXPRESSLY UNDERSTANDS AND AGREES THAT EXCLUDING CASES WHERE LIABILITY MAY NOT BY LAW BE LIMITED OR EXCLUDED, TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ELUKTRONICS INC OR ANY AFFILIATE BE LIABLE, WHETHER IN CONTRACT, NEGLIGENCE OR OTHERWISE, FOR ANY LOST IMAGES, DATA, REVENUE OR PROFIT, OR FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSSES OR EXPENSES OF ANY KIND. IF ANY EXCLUSION, DISCLAIMER OR OTHER PROVISION IS HELD INVALID FOR ANY REASON AND ELUKTRONICS INC OR AN AFFILIATE BECOMES LIABLE FOR LOSS OR DAMAGE THAT COULD OTHERWISE BE LIMITED, THAT LIABILITY, WHETHER IN CONTRACT, NEGLIGENCE OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER FOR THE PRODUCT(S) WHICH CAUSED THE LOSS OR DAMAGE.
